Terms of Service
1. Overview
Xposure is an online marketplace connecting emerging Australian fashion brands with customers. By accessing or using our platform, you agree to be bound by these terms. These terms apply to all users of the platform including shoppers, brands, and visitors.
2. Accounts
You may need to create an account to access certain features. You are responsible for maintaining the security of your account and for all activities that occur under it. You must provide accurate and complete information when creating an account. You must be at least 18 years old to create an account.
3. Purchases
All purchases are processed through Stripe. Prices are listed in Australian Dollars (AUD) unless otherwise stated. Products are sold by individual brands, not by Xposure directly. By placing an order, you agree to pay the listed price including any applicable shipping charges. Orders are confirmed once payment is successfully processed.
4. Shipping
Shipping is handled directly by each brand. Estimated delivery times are provided as a guide only and may vary. Xposure is not responsible for shipping delays caused by carriers, customs, or events outside our control. For questions about your shipment, contact the brand directly via their store page.
5. Returns & Refunds
Returns and refunds are handled in accordance with our Returns Policy and Australian Consumer Law. Change of mind returns are accepted within 14 days of delivery for unworn items in original condition. Faulty or incorrect items are eligible for a full refund including original shipping. 6. Brand Accounts
Brands applying to sell on Xposure must submit an application for review. Approved brands must comply with our Seller Agreement, which covers commission, fulfilment standards, returns obligations, and payout terms. Xposure reserves the right to approve, reject, or remove any brand at its discretion.
7. Voting & Rankings
Registered users receive one vote per calendar month to contribute to the Xposure Top 10 brand rankings. Votes are final and cannot be changed once submitted. They reset at the start of each month. Xposure reserves the right to disqualify votes or adjust rankings in cases of suspected manipulation or abuse.
8. Intellectual Property
All content on Xposure including design, logos, and code is owned by Xposure. Brands retain ownership of their product images, descriptions, and brand assets. You may not reproduce, distribute, or use any content from Xposure without permission.
9. Prohibited Conduct
You agree not to use the platform for any unlawful purpose, interfere with the platform's operation, attempt to gain unauthorised access to any part of the platform, submit false or misleading information, or use automated tools to scrape or collect data.
10. Limitation of Liability
Xposure acts as a marketplace platform only. We are not liable for the quality, safety, or legality of products sold by brands. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Nothing in these terms limits rights you have under Australian Consumer Law.
11. Changes to Terms
We may update these terms from time to time. We will notify users of significant changes via email or through the platform. Continued use of the platform after changes are posted constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
